The DLD transfer appointment: what happens on the day

Ownership of a Dubai property changes hands in a single appointment at a registered trustee office, and it usually takes about 45 minutes. Everything before it is preparation. Everything after it is admin. The transfer appointment is the moment.

Buyers and sellers who understand the sequence turn up with the right cheques and leave with the right paperwork. Those who do not tend to lose a day and reschedule.

What a trustee office is

Registered trustee offices are private companies licensed by the Dubai Land Department to carry out property registration on its behalf. There are a number of them across the city, they keep normal office hours, and you book a slot rather than queue. They collect the fees, verify the parties, and submit the registration. The Dubai Land Department issues the new title deed off the back of it.

You do not go to the Dubai Land Department itself for a standard resale. You go to a trustee.

Who has to be there

Both the buyer and the seller, in person, with original passports and Emirates ID where held. If either party cannot attend, a notarised power of attorney specific to the sale of that property allows a representative to sign. A general power of attorney is often not accepted, so check the wording well ahead of the day.

If a bank is involved on either side, its representative attends too. Where the seller has a mortgage, the seller's bank has to release its charge before the new deed can issue. Where the buyer has a mortgage, the buyer's bank issues its cheque at the appointment. Two banks in one room is the slowest version of this appointment and the one most worth over preparing for. What to bring

  • Original passports, and Emirates ID and visa copies for residents.
  • The original title deed from the seller.
  • The valid developer no objection certificate, which the seller obtains. See what sellers need before transfer.
  • The signed Form F.
  • Manager's cheques, not personal cheques, made out as instructed by the trustee.
  • Company documents where a corporate entity is buying or selling, including a valid trade licence and a board resolution.

The money

This is where most of the friction sits. Expect to issue several separate manager's cheques rather than one.

  • The balance of the purchase price to the seller, or to the seller's bank where a mortgage is being settled.
  • The Dubai Land Department transfer fee, which is 4 per cent of the sale price plus an administrative charge.
  • The trustee office fee, which is a few thousand dirhams and scales with the property value.
  • The title deed issuance fee.
  • Agency commission, if it is being settled at the appointment.

The sequence on the day

The appointment runs in a fairly fixed order.

  • Both parties are identified and the file is checked, including the no objection certificate and the Form F.
  • If the seller has a mortgage, their bank confirms settlement and releases the charge.
  • The buyer hands over the price cheque and the fee cheques.
  • The trustee submits the registration to the Dubai Land Department.
  • The new title deed is issued, usually the same day, in the buyer's name.

At that point ownership has moved. Utilities, service charge accounts and any tenancy are the follow up.

What stops a transfer on the day

The recurring causes are boringly consistent.

  • The no objection certificate has expired. Most are valid 30 days.
  • A cheque is made out to the wrong payee or for the wrong amount.
  • A passport has been renewed and the deed carries the old number with no supporting link.
  • A joint owner has not attended and has not given a valid power of attorney.
  • The seller's bank has not confirmed the settlement figure in time.
  • A company's trade licence has lapsed.

After the appointment

An expired developer no objection certificate, followed closely by a manager's cheque made out to the wrong payee. Both are avoidable, and both are discovered in the room, where they cannot be fixed. Confirm the certificate's validity date and the cheque instructions in writing before you travel.
